About the extradition from Germany to Russia of a citizen of the Russian Federation Shin Melis Bo-Khenovich accused of drug smuggling as a member of an organized group

Today, on October 26th, 2012 upon the request of the General Prosecutor's office of the Russian Federation, the competent authorities of Germany are extraditing a citizen of the Russian Federation Melis Shin. By the investigation authorities he is accused of committing crimes foreseen by part 4 of article 188 (smuggling in aggravating circumstances), paragraphs "a” and “d" in part 3 of article 228-1 (illegal transferring of narcotic substances by an organized group in especially large scale), part 1 of article 30, paragraphs "a” and “d" in part 3 of article 228-1 (preparation to illegal sale of narcotic substances by an organized group in especially large scale) of the Criminal code of the Russian Federation.

It is established that in 2004 Shin, in a membership of an organized criminal group, illegally acquired on the territory of the Republic of Kazakhstan narcotic drugs, in the structure of which the net weight of heroin amounted to about 26 kg, and the opium with total weight of an undried condition of about 670 kg (in terms of dry substance - more than 475 kg).

In May 2004 the accomplices of a criminal group made a hiding place in a «KAMAZ» truck that was specially designed for transportation of drugs. They loaded the same truck with 10.5 tons of fresh cabbage which was specially purchased on the bypass highway of the city of Shymkent of the Republic of Kazakhstan for the visibility of legal nature of traveling to the Russian Federation and concealment of the fact of transportation of drugs. The cargo was directed to Samara region.

Passing by the territory of the Republic of Bashkortostan the driver of the truck lost control and the truck turned turtle. During the examination of the scene of the incident the drugs were discovered by the police officers and were taken away.

After placing of Shin into the international wanted list in February 2006 it was found out that this person was already arrested by the law enforcement authorities of Germany for the crimes committed in the territory of that state since June 2005. At that time the General Prosecutor's office of the Russian Federation forwarded to the competent authorities of Germany a request about his extradition for bringing him to the criminal liability.

The German side expressed its consent to extradition of Shin to Russia but his extradition was postponed until the end of the investigation conducted by the German colleagues.

In August 2007 by the regional court of the city of Koblenz (Germany) Shin was sentenced to 10 years of imprisonment for the crimes related with illegal turnover of drugs.

In December 2008 when the sentence came into legal force, the General Prosecutor's office of the Russian Federation, in accordance with the European Convention on extradition dated 13.12.1957, appealed to German colleagues with a request for extradition of Shin on temporary bases for carrying out of necessary investigative procedures.

In March 2009 the mentioned request for extradition on temporary bases was satisfied.

In the period of temporary extradition, the preliminary investigation of the criminal case was completed and in February 2010 Melis Shin was sentenced to 15,5 years of imprisonment in a penal colony of strict regime with a penalty of 200 000 rubles for the state benefit.

After coming of the sentence into legal force, the General Prosecutor's office of the Russian Federation in March of 2011 again applied to the authorities of Germany with a request for extradition of Melis Shin for execution of the sentence of court.

In May 2012 the German side informed the General Prosecutor's office of the Russian Federation about the readiness of early implementation of the extradition of this person in accordance with the Russian request on extradition for execution of the punishment charged by the court.

Today, accompanied by the employees of the FSIN (Federal Service of Execution of Punishment) of Russia and the Russian Bureau of Interpol, Melis Shin is extradited to Russia.
