The delegation of the General Prosecutor's office of the Russian Federation headed by the Deputy General Prosecutor Alexander Zvyagintsev participated in the 6th plenary meeting of the Consultative Council of European prosecutors of the CCPE which was held on 24-25 November of the current year in the headquarters of the Council of Europe in Strasbourg (France).
Established in 2005 the CCPE is an Advisory body of the Committee of Ministers of the Council of Europe (CMCE) - the main body of this most representative European organization uniting 47 countries of the Old continent.
The main result of the meeting was the adoption of the conclusion № 6 of the CCPE "On interrelations of prosecutors with the administration of penitentiary institutions" which, as an opinion of the European public Prosecutor's community, will be forwarded for consideration of the Committee of Ministers of the Council of Europe.
Development of conclusion lasted for more than a year. Russian representatives in the head of the Deputy General Prosecutor Alexander Zvyagintsev, who oversees not only the international cooperation, but also issues of supervision of legality of the execution of criminal penalties, took the most active part in this work as well as in two meetings of the special working group, created with the aim of preparing a draft conclusion for consideration at a plenary meeting of the CCPE. It is sufficient to say that the discussion at the meeting of the CCPE was held according to the project submitted by the Russian delegation.
The accepted conclusion contains recommendations concerning the realization of supervision by the prosecutors for the observance of the rights of persons in places of deprivation of liberty (at the pre-trial and trial stages of the criminal process, as well as during the execution of sentence).
In the discussions at the meeting of the CCPE representatives of many States (in particular, Belgium, Hungary, Germany, Spain, Monaco, the Netherlands and France) shared their experience of work in the mentioned sphere. The delegation of the General Prosecutor office of Russia has actually held a presentation of the activities of the national Prosecutor's office, widely introducing basic directions, powers, means and methods as well as the results of its work.
The speeches of several representatives including the speeches of representatives of the Consultative Council of European judges contented critics of conditions of detention and observance of human rights in places of detention. Moreover, there were expressed the opinions about the necessity of increasing of effectiveness of supervision activities of the Prosecutor's office and the expansion of its functions in the discussed sphere (in some countries this supervision is carried out only over the detention of persons in police stations). In Europe there should not be places of detention, closed for the public Prosecutor's supervision.
Many participants called for the implementation of more active role of the Prosecutor's office in the formation and implementation of the national criminal policy, including in the penitentiary sphere.
Defending its positions, during the discussion of the draft conclusions, the Russian delegation gave speeches more than 40 times. In the accepted conclusion of the CCPE, it was mainly reflected the rich experience of the Prosecutor's office of Russia in the implementation of the supervision of legality and observance of human rights in the places of imprisonment.
At the meeting it was also defined the program of work of the CCPE for the years of 2012-2013: next year it is planned to adopt a conclusion on the issue of resource provision of the public Prosecutor's activities, in 2013 - conclusion on the interrelations of prosecutors with the media.
By the decision of the European community of public prosecutors, Deputy General Prosecutor of the Russian Federation Alexander Zvyagintsev once again elected into the board of the special group of the CCPE, which was entrusted the development of the projects of the mentioned conclusions.
Moreover, the CCPE adopted a decision on the beginning of work on possible amendments into the recommendation of the Committee of Ministers 2000 (19) dated October 6, 2000 to the member States about the role of public prosecution in the system of criminal justice.
