About the extradition from Spain to Russia of citizens of the Russian Federation Konstantin Mrykhin and Sergey Urigaev

Today, upon the request of the General Prosecutor's office of the Russian Federation, the competent authorities of the Kingdom of Spain are extraditing to Russia a citizen of the Russian Federation Konstantin Mrykhin. By the investigation bodies he is accused of a crime foreseen by part 3 article 238 (rendering of services which do not meet the requirements of the safety of life and health of consumers committed by an organized group and entailing by negligence the infliction of grave injury to health, death of two and more persons) of the Criminal Code of the Russian Federation.

The criminal case against Mrykhin is in the execution stage of the Investigatory Department of Investigatory Committee of Russia for Perm Krai.

It is determined that in the period from January 2002 to December 5, 2009 Mrykhin, being one of the actual owners and managers of the cafe "Khromaya Loshad’" (Lame horse) in the city of Perm, performed catering services and organized cultural and entertainment events which did not meet the requirements of safety of life and health of visitors.

So, during the repair works in the cafe "Khromaya Loshad’" by his and other persons’ approval it was allowed the use of the constructions and materials that do not meet the requirements of the current standards. By the beneficial owners of the cafe "Khromaya Loshad’" there were allowed numerous violations of the fire safety Rules. As an outcome, in the night from the 4th to the 5th of December 2009 during the celebration of a holiday event, in the program of which there were included pyrotechnic show-fireworks which was a direct violation of the existing ban, by a small particle of the pyrotechnic device that reached the ceiling and stuck in, there was an ignition of cellular plastic insulation by which the ceiling of the hall of the café was covered. Lack of emergency exits led to panic and difficulty of exit from the premises in the conditions of fire. As a result of all these due to poisoning with the products of combustion, of carbon monoxide and the burns received there were killed 156 people, 83 people got injuries of various degrees of gravity.

Since Mrykhin escaped from investigation, in March 2010 he was declared in the Federal search and in May 2010 he was placed into international wanted list.

In August 2010 Mrykhin was detained in the city of Barcelona (the Kingdom of Spain).

In September 2010 the General Prosecutor's office of the Russian Federation forwarded to the Ministry of justice of the Kingdom of Spain a request about his extradition for attracting to the criminal liability.

In March 2011 the request of the General Prosecutor's office of the Russian Federation about extradition of Mrykhin was satisfied. Additionally, in connection with the application of the specified person for refugee status the act of his transference has been postponed for an indefinite period.

In May 2011 the Interpol of Spain informed that the Spanish authorities refused Mrykhin in providing of an asylum and accepted the final decision about its extradition to the Russian side.

Also, today, the competent authorities of the Kingdom of Spain are extraditing to Russia a citizen of the Russian Federation Sergey Urigaev. By the investigation bodies he is accused of committing crimes foreseen by part 1 of article 222 (illegal purchase, storage and carrying of firearms and ammunition to it) and part 1 of article 105 (murder, i.e. the intentional causing of death to other person) of the Criminal Code of the Russian Federation.

The criminal case against Urigaev is in the execution stage of the investigatory department of the Investigatory Committee of Russia for the Republic of North Ossetia - Alania.

It is determined that in June 2004 Urigaev in the city of Vladikavkaz in the course of an arisen quarrel near a hostel of the North-Ossetian State University, intentionally fired two shots into a citizen Tskhovrebov from his pistol of "TT" model which was illegally possessed by him and as a result caused the death of the victim which occurred at the place of the incident.

In August 2004 Urigaev was declared in the Federal search and in March 2005 it was announced a decision about his placement into the international wanted list.

Urigaev had been detained twice on the territory of Spain, however, introducing himself as another person and having the citizenship of Georgia he was released from custody.

In November 2009 the General Prosecutor's office of the Russian Federation forwarded to the Ministry of justice of the Kingdom of Spain a request for his extradition.

In January 2011 Urigaev was again detained in the city of San Sebastian.

In May 2011 the Ministry of Foreign Affairs of Spain informed that the competent authorities of that state accepted a final decision about his extradition to Russia for bringing to criminal liability.

Today, accompanied by the employees of the FSIN (Federal Service of Execution of Punishment) of Russia and the Russian Bureau of Interpol, Mrykhin and Urigaev are extradited to Russia.
