Extradition of Mr Shumshum Shubaev, a citizen of the Russian Federation and Israel, who is accused of robbery and murder, to Russia from Israel

Today, at the request of the Prosecutor General's Office of the Russian Federation, the competent authorities of the State of Israel are extraditing to Russia Shumshum Shubaev, a citizen of the Russian Federation and the State of Israel. Shumshum Shubaev has been on the wanted list for 10 years on the charges of an intentional murder.

After he was established on the territory of the State of Israel in September 2003, the Prosecutor General's Office of the Russian Federation forwarded a request on his extradition to the Ministry of Justice of the State of Israel.

The consideration of the request for extradition met with difficulties, as the Ministry of the State of Israel asked for guarantees that Shubaev, as a citizen of the State of Israel, would be returned to Israel to serve his punishment, in case the judgment of conviction is passed in his respect.

In August 2005 the Prosecutor General's Office of Russia forwarded to the Ministry of Justice of the State of Israel the explanation of the order of the transfer of a citizen of a foreign state, sentenced to imprisonment by the court of the Russian Federation to serve the punishment in the state of origin. The Prosecutor General's Office of Russia explained the limits of its competence, providing the guarantees set out in the Russian laws.

Moreover, the issues of extradition of the persons who are sought by Russian law enforcement agencies from the State of Israel to Russia, including Shubaev, were discussed at the meetings of top officials of the General Department of International Legal Cooperation of the Prosecutor General's Office of the Russian Federation with the representatives of the Embassy of the State of Israel and the Israeli Ministry of Justice in October 2006 and June 2008.

In May 2008, Mr. Shubaev was detained in the territory of the State of Israel on the grounds of the request of the Prosecutor General's Office of the Russian Federation. After that the State of Israel requested additional data on guarantees that the death penalty would not be applied and the explanation of the Russian law concerning a selection of a preventive measure in the form of detention. The necessary data were expeditiously forwarded to the Ministry of Justice of the State of Israel.

In April 2010 the competent authorities of the State of Israel passed a decision to extradite Shubaev.

Over the last 7 years it was the second request on extradition which was granted by the State of Israel.

In April 2007, the Israeli party had extradited Alexander Levin who was brought to criminal liability for robbery and murder.
