About extradition from Spain to Russia of Marat Polyansky, accused of committing of a number of crimes being a member of so called “orehovskaya” bandit group

Today upon the request of the Prosecutor General’s Office of the Russian Federation competent authorities of the Kingdom of Spain extradite citizen of the Russian Federation Marat Polyansky to Russia. He is accused by the investigative authorities of committing of crimes provided in Article 209 (2) (Participation in a stable armed group (band) or in the attacks committed by it), Article 105 (2) (Homicide) and number of other articles of the Criminal Code of the Russian Federation.

It is established that citizen of the Russian Federation Marat Polyansky being active member of the so called “orehovskaya” bandit group, which is, according to opinion of the investigation, responsible for no less than 50 murders and attempts to murder on the territory of the city of Moscow, Moscow and Vladimir Regions< Greece, Ukraine, repeatedly participated in attacks committed by it.

So in June 1997 Polyansky together with other members of armed criminal group committed murder of advocate. In the end of September 1997 Polyansky according to prior collusion with other members of the bandit group with the aim of maintenance of inner discipline in the bandit group shot with handguns two members of the same criminal group, burying corpses in the hole prepared beforehand.

In September 1998 Polyansky together with other members of the bandit group, being in cabin of automobile VAZ-21083, having prepared beforehand two submachine guns AK-74 and moving on Street Ostozhenka, obstructed way to the automobile Toyota Land Cruiser, with 4 people inside, and opened submachine gun fire. As a result of attack one passenger was killed and three others were wounded with different heaviness. Additionally in October 1998 Polyansky Polyansky together with other members of the bandit group committed murder of member of their criminal group and his wife.

In July 2000 putting under custody as a measure of restriction was selected in respect of Marat Polyansky.

The Investigative Department of the Investigative Committee at the Prosecutor’s Office of the Russian Federation for the city of Moscow is inquiring into criminal matter upon accusation in respect of Polyansky.

On the ground of the request for extradition of the Prosecutor General’s Office of the Russian Federation of 17 July 2000 leader of the bandit group Sergey Butorin and member of the bandit group Marat Polyansky in February 2001 were arrested in the city of Kasteldefels of the Kingdom of Spain. Because during arrest firearms were found with them, court of the city of Barselona sentenced them to 8 years 8 months of imprisonment.

In connection with expiration on 08 October 2009 of the period of serving of punishment by Polyansky according to conviction of the Spanish court, transfer of him to the Russian party was planned on 09 October 2009. However on the last day of the period of serving of punishment Polyansky applied to the authorities of Spain with request to grant him status of refugee.

The Prosecutor General’s Office of the Russian Federation immediately reacted on this information. Owing to the forwarded in proper time letter of the Deputy of the Prosecutor General of the Russian Federation Alexander Zvyagintsev, stating that granting of status of refugee to the person accused of committing of grave and especially grave crimes of the common criminal character will contradict to provisions of the Convention on the status of refugees of 28 July 1951, the Spanish party considered application of Polyansky in extraordinary order and denied its satisfaction.

Today Marat Polyansky, accompanied by officers of Russian bureau of Interpol and Federal Service for Execution of Punishment was extradited to Russia.
