Extradition of Russian Citizen Rustam Barkinhoev, Accused of robbery attacks on citizens, from Republic of Austria to Russia

Today upon the request of the Prosecutor General’s Office of the Russian Federation competent authorities of the Republic of Austria extradite citizen of the Russian Federation Rustam Barkinhoev to Russia.

He is accused by the investigative authorities of committing of 2 crimes provided in Article 162 (“a”, 4) (robbery that is attack for the purpose of stealing another’s property on a large scale, committed with threat to apply violence dangerous for life or health, with application of weapons, by the organized group), crimes provided in Article 162 (“a”, 4) (robbery that is attack for the purpose of stealing another’s property on a large scale, committed with threat to apply violence dangerous for life or health, with application of weapons, with illegal penetration into a dwelling, by the organized group), Article 325 (1, 2) (The stealing of important personal and other official documents for personal interest), Article 175 (3) (The acquisition of property not promised beforehand and known to be acquired by criminal means, committed by the organized group), Article 222 (3) (Illegal acquisition, keeping of firearms and ammunition, committed by the organized group) of the Criminal Code of the Russian Federation.

The Investigative Department of the Investigative Committee at the Prosecutor’s Office of the Russian Federation for the Republic of Ingushetia is inquiring into criminal matter upon charges in respect of Barkinhoev.

It was established that in January 2004, together with other persons, being residents of Republics of Ingushetiya and North Osetiya – Alaniya, created on the territory of the city of Nazran the organized group for committing of robbery attacks on citizens. Members of the organized group were provided with firearms and ammunition of different types, camouflage uniform, face masks, transport, portable radio transmitters, mobile phone communications and different state registration plates for automobile, used in committing attacks, what let perform interaction and planning of criminal activities of the organized criminal group.

According to the information of the investigation in the period from January to March 2004 Barkinhoev committed three attacks on citizens of the Republic of Ingushetia, in the course of which personal property of the victims, automobiles and other personal and other official documents belonging to them were stolen. Furthermore Barkinhoev bought automobile VAZ-2105 stolen in the city of Vladikavkaz, using which he then committed other robbery attacks.

As Barkinhoev escaped criminal prosecution and his location could not have been established, in October 2005 investigation of the criminal matter was suspended in connection with search for the accused.

In September 2008 Barkinhoev was arrested by the Austrian law-enforcement agencies for committing of theft on the territory of this state and in November 2008 was sentenced by the District Austrian court to 18 months of imprisonment.

In October 2008 the Prosecutor General’s Office of the Russian Federation forwarded to the Federal Ministry of Justice of the Republic of Austria a Request for extradition of Barkinhoev.

In April 2009 the competent authorities of Austria informed the Prosecutor General’s Office of the Russian Federation of the satisfaction of Request for extradition of Barkinhoev, and in August informed of the decision to execute preterm extradition of him to Russia.

Today Rustam Barkinhoev, accompanied by officers of Russian bureau of Interpol and Federal Service for Execution of Punishment, is being extradited to Russia.
