Extradition of Russian Citizens Evgeny Nekrasov and Andrey Tarka, Charged with Crimes Committed in Russia, from Spain to Russia

Upon request of the Prosecutor General’s Office of the Russian Federation, the competent authorities of the Kingdom of Spain extradited Russian citizen Evgeny Nekrasov to Russia.

The investigative authorities charged Ye.Nekrasov with the commission of crimes defined by Article 159, part 4 (fraud committed by an organized group on especially large scale) and Article 30, part 3, Article 159, part 4 (attempted fraud committed by an organized group on especially large scale) of the Criminal Code of the Russian Federation.

The criminal case against Ye.Nekrasov is under investigation by the Investigative Department of the Investigative Committee under the Public Prosecution Service of the Russian Federation for the Krasnodar Territory.

The investigative authorities established that Ye.Nekrasov, as a member of an organized criminal group from April to September 2005 in Krasnodar, fraudulently acquired title to plots of land being in municipal ownership by the city of Krasnodar. Moreover, the members of the criminal group used illegal civil judgments issued by a chairman of one of the district courts of Krasnodar.

The criminal activities of Ye.Nekrasov resulted in registration of title to plots of land meant for further sale.

The total cadastral value of the plots of land illegally registered by Ye.Nekrasov amounted to over RUB 690 million. Upon initiation of the criminal case, Ye.Nekrasov escaped.

In February 2007, Ye.Nekrasov was put on international wanted list and in May 2008 he was detained in Spain.

In June 2008, the Prosecutor General’s Office of the Russian Federation submitted a request for his extradition to the competent authorities of the Kingdom of Spain. In January 2009, the Council of Ministers of the Kingdom of Spain ruled to extradite Ye.Nekrasov to Russia. However, the final decision on extradition of Ye.Nekrasov to the Russian Federation for criminal prosecution was made in April 2009 because he filed an application for refugee status, which was rejected by the Spanish authorities.

Moreover, today the competent authorities of the Kingdom of Spain have extradited Russian citizen Andrey Tarka.

The investigative authorities charged A.Tarka with the commission of crimes stipulated by Article 112, part 1 (willful infliction of harm to health of medium gravity) of the Criminal Code of the Russian Federation. In July 2007, in the town of Atkarsk of the Saratov Region, he beat up Mr. Dragunkin breaking his rib.

The criminal case against A.Tarka is under investigation by the Investigative Unit under the Division of Internal Affairs for the Atkarsk Municipal District of the Saratov Region.

In October 2008, A.Tarka was put on international wanted list and one month later he was detained on the territory of Spain. In October 2008, the Prosecutor General’s Office of the Russian Federation sent a request for his extradition to the competent authorities of the Kingdom of Spain, which was satisfied in April 2009.

Today, both Ye.Nekrasov and A.Tarka have been extradited to Russia under the escort of the Russian Interpol Bureau and the Federal Penitentiary Service officers.
