On December 31, 2008 upon request for extradition of the Prosecutor General’s Office of the Russian Federation, the competent authorities of Spain have extradited Russian citizen Murat Gasayev to Russia.
The investigative authorities charged M.Gasayev with crimes under Article 317 (infringement on life of a law-enforcement officer), Article 209, part 2 (participation in a stable armed group (gang) or in its attacks), Article 210, part 2 (participation in a criminal association), Article 30, part 3, Article 105, part 2, paras. “a”, “f”, “g”, “h” (attempted murder of two or more persons committed in a socially hazardous manner by an organized group from mercenary motives associated with banditry), Article 105, part 2, paras. “a”, “s”, “g”, “h” (murder of two or more persons committed in a socially hazardous manner by an organized group from mercenary motives associated with banditry), Article 226, part 2, paras. “a”, “b” (theft of firearms, ammunition, explosive devices committed by an organized group with the use of violence posing danger to human life and health and under threat of such violence), Article 166, part 4 (unlawful occupancy of a car (autotheft) without the purpose of stealing committed by an organized group with the use of violence in a manner dangerous to human life and health or under threat of such violence), Article 127, part 3 (deprivation of freedom of two or more persons not related with their abduction committed by an organized group with use of violence), Article 222, part 3 (illegal acquisition, sale, storage, transportation and bearing of firearms, their basic parts, ammunition, explosives and explosive devices committed by an organized group) of the Criminal Code of the Russian Federation.
The investigative authorities discovered that in summer 2003, M.Gasayev while staying in a forest camp of the gang “Khalifat” led by A.R.Kerimov became its member. That gang was part of a larger criminal association headed by an Arab Taufik-al-Jedhani (call signal “Abu-Dzeit”). The aim of the criminal association was to abrupt the territories of the Republic of Ingushetia and the Chechen Republic away from the Russian Federation, and to establish an independent Islamic state on their territories. M.Gasayev got a call signal “Abdul-Malik” in the gang “Khalifat”.
As an active member of the gang, M.Gasayev repeatedly participated in terrorist acts and attacks on representatives of government and administration authorities, law-enforcement officers and military personnel on the territory of the North-Caucasian Region.
At night from June 21 till June 22, 2004, M.Gasayev participated in an attack on the Office of the Ministry of Internal Affairs in Nazran, Republic of Ingushetia. As the result of the attack, one officer of the Ministry of Internal Affairs of the Republic of Ingushetia was killed, 7 were injured. Furthermore, a property damage of RUB 10.5 million was caused.
In December 2006, M.Gasayev was put on international wanted list and four days later he was arrested in Spain.
At the same time, the Prosecutor General’s Office of the Russian Federation sent a request for his extradition to the Ministry of Justice of the Kingdom of Spain to initiate criminal proceedings against the fugitive.
The Spanish court satisfied the request of the Prosecutor General’s Office of the Russian Federation. However, M.Gasayev filed a complaint to the European Court of Human Rights, which was dismissed. On December 12, 2008, the Council of Ministers made a final decision to satisfy the request of the Prosecutor General’s Office of the Russian Federation for extradition of M.Gasayev.
The extradition of M.Gasayev was the result of a long and meticulous joint work of the Prosecutor General’s Office of the Russian Federation, Ministry of Foreign Affairs of the Russian Federation and its representative office in Spain, as well as the Russian intelligence agencies.
It should be noted that the extradition of M.Gasayev was a question under discussion during the visit of the Russian Prosecutor General Yuri Chaika to Spain in June 2007, and it was also further discussed at bilateral talks of the executives of the Prosecutor General’s Office of the Russian Federation with the competent authorities of Spain during the meetings of the Russo-Spanish Counter-Terrorism Working Group in the Ministry of Foreign Affairs of the Russian Federation.
Today, M.Gasayev has been extradited to Russia under the escort of the Russian Interpol Bureau and the Federal Penitentiary Service officers.
