Under current federal law and order of the Attorney General of the Russian Federation the prosecutors systematically review lawfulness of detention of persons suspected or accused of committing crimes.
These checks were conducted on several occasions and in respect of the detained vice - President of OAO OC «Yukos» Vasily Alexanyan, including inquiries from the European Court of Human Rights, the Human Rights Ombudsman in the Russian Federation V.P Lukin, as well as in connection with publications in the media.
According to the results of audits it was discovered that in the investigation of the criminal case on charges against Aleksanyan the investigators didn’t commit actions or made decisions, degrading his honour and dignity or causing danger to his life and health. The actions of the investigators against Aleksanyan were based on the requirements of criminal procedure laws of the Russian Federation and the European Convention for Protection of Human Rights and Fundamental Freedoms.
In response to recent statements in the media about the poor conditions of detention of Vice-President of OAO OC «Yukos» Alexanian, the prosecutor's office conducted a check, which revealed that he had been kept in a multidisciplinary hospital of remand prison № 1 in Moscow in an individual room of 17 square meters, which meets all international standards. In the room there was a TV, a refrigerator, all the necessary equipment, including a shower with hot and cold water. The microclimate corresponds to sanitary norms and rules.
Preventive measure selected in regard to Aleksanyan in the form of detention does not limit his possibility of obtaining necessary specialized medical care. To provide such medical assistance at any hospital in SIZO-1 in Moscow there are appropriate specialists, as well as medical equipment and necessary medication.
During detention, Aleksanyan was repeatedly examined by doctors - specialists of health facilities and health authorities. Cases of refusal in allowing Aleksanyan to obtain medicine packages from relatives have not been identified. In the period from November 2007 to January of this year, he received 11 such packages.
According to medical specialists, as a result of examination and laboratory tests inflammatory lung diseases of Aleksanyan have not been detected.
On January 30 this year Alexanyan was examined by medical personnel, his state of health was satisfactory, allowing him to participate in the Court trials. It also confirms the findings of previous commission forensic examination.
It should be noted that previously Aleksanyan repeatedly refused to be examined. This is recorded in medical records.
The audit didn’t detect violations of the law on conditions of detention of suspects and defendants, as well as Aleksanyan receiving necessary medical treatment.
