General Prosecutor's Office of the Russian Federation organized a constant monitoring of the situation in the implementation of priority national projects. In order to ensure strict compliance with the current legislation the Attorney General of Russian Federation issued on 19.01.2007 Decree № 11 'On the organization of public prosecutor's supervision over the implementation of laws in executing priority national projects.' In order to ensure an integrated approach to detection and combat of offences, procuratorial subjects of the Russian Federation established working groups, composed of representatives of law-enforcement and supervisory bodies.
One of the main reasons for hindering the implementation of priority national projects, is late adoption of the necessary legal acts by aithorities. Red tape results in violations of the rights of citizens to participate in the activities offered by the projects. At the same time, local governments pass illegal acts that restrict the rights of citizens.
Thus, according to prosecutors’ protests republics of Altai, Buryatia, Smolensk, Novosibirsk, Chita, areas, the Krasnoyarsk territory regulatory acts of health authorities were amended in accordance with federal legislation, as well as local acts of medical institutions, establishing illegal procedure for spending funds received for additional hospitalization, and the funds received through delivery certificates for purposes not covered by existing legislation.
Often, local governments create obstacles to the participation of citizens in the priority national projects. In the Kirov, Nizhny Novgorod, Samara, Saratov areas the citizens were demanded to provide documents not included in the list established by the current legislation.
Public prosecutors of republics of Bashkortostan, Mari, Sakha (Yakutia), the Udmurt Republic, the Kirov, Kurgan, Nizhny Novgorod, Orenburg, Penza, Samara, Tyumen, Ulyanovsk areas prevented numerous violations of a time frame for consideration of applications on permits for construction, request of documents from developers that are not stipulated by law.
In the Republic of Komi, Novgorod, Voronezh, Ivanovo, the Kursk areas, the Khanty-Mansi Autonomous Okrug - Yugra prosecutors’s inspections put a stop to the actions of officials, allowing red tape when considering applications for allocation of land.
Only in 2007, prosecutors introduced more than 18.5 thousand submissions on eliminating violations of the legislation, as a result 6.5 thousand individuals were held responsible. Furthermore, more than 6 thousand warnings were given about the inadmissibility of violations of the law, more than 2 thousand persons were brought to administrative responsibility for the protests of prosecutors, nearly 4.4 thousand instruments were amended in accordance with the law.
