Today, on October 8, 2014, the twelfth meeting of the Prosecutors General from the member countries of the Shanghai Cooperation Organization (SCO) took place in Tashkent (Uzbekistan).
The event was attended by the Russian Prosecutor General Yuri Chaika, Prosecutor General of the Republic of Uzbekistan Rashitdzhon Kadyrov, Prosecutor General of the Republic of Kazakhstan Askhat Daulbaev, Procurator General of the Supreme People's Procuratorate of the People's Republic of China Cao Jianming, Prosecutor General of the Republic of Tajikistan Sherkhoni Salimzoda, Deputy Prosecutor General of the Kyrgyz Republic - Military Prosecutor of the Kyrgyz Republic Marat Eshperov, Secretary General of the SCO Dmitry Mezentsev, Director of the Executive Committee of the Regional Anti-Terrorist Structure of the SCO Zhang Xinfeng, as well as a number of senior staff of Prosecutor General’s Offices from the member countries of the SCO.
The meeting included delegations of Prosecutor Offices from the observer states of the SCO: Islamic Republic of Afghanistan, Republic of India, Islamic Republic of Iran, Mongolia and Islamic Republic of Pakistan.
During the meeting, participants discussed the issues of supervision over the implementation of laws in the sphere of entrepreneurs’ rights protection, environmental legislation, enforcement of rights and legitimate interests of minors in the member countries of the SCO.
The Russian Prosecutor General Yuri Chaika made a presentation on the Supervision over the Implementation of Environmental Legislation in the Member Countries of the SCO.
Two sides exchanged information on the experience of prosecutorial supervision over implementation of laws in these areas and discussed the results of the review of the legislation and practice of the SCO member countries in the sphere of identification, confiscation and return of income (assets).
During the event, participants identified the need to take effective measures to protect the environment and preserve ecosystems, prevent irrational use of natural resources and devastating effects of man-made disasters. They noted the paramount importance of the protection of rights, freedoms and legitimate interests of minors, and also recognized the need to strengthen international cooperation in identification, tracing, seizure and return of income (assets) that was criminally obtained in the country of their origin.
The meeting was held in a constructive and friendly atmosphere, in a spirit of mutual trust and understanding.
According to the results of the meeting, a number of decisions aimed at improving the effectiveness of an interagency cooperation were adopted. In particular, the parties agreed to expand and deepen the cooperation of the prosecution authorities of the SCO member countries, to share regulatory acts, executive, scientific, methodological and other materials for the prosecutorial supervision in the field of environmental law enforcement, protection of rights of businessmen and rights and legitimate interests of minors.
The leaders of Prosecutor General’s Offices of the SCO member countries agreed to take effective measures to ensure the implementation of legislation in the field of sustainable use of natural resources, reduction of emissions of pollutants and greenhouse gases, strengthening the role of civil society in addressing the issues of environmental protection, strengthening the supervision over the relevant government agencies and organizations in these areas.
Simultaneously the participants decided to fully promote the creation of an enabling environment for private entrepreneurs, providing the steady pursuance of the provisions of national legislation aimed at comprehensive support, benefits and preferences, compliance with the provided legal guarantees and measures to protect their rights and interests of foreign investors.
The prosecutors general of the SCO member countries decided to pay special attention to providing adequate conditions of study and work for minors, improving the legal framework of child labor, prevention of forced labor, proper use of funds aimed at children’s education and health.
Cooperation on mutual legal assistance in criminal matters relating to the identification, tracing, seizure and return of proceeds of crime (assets) to their countries of origin will be also intensified. Pursuant to the provisions of the UN Convention against Corruption and other international agreements, the parties will improve the activities of the competent authorities, share information and best enforcement practices, as well as innovations in the legislation in this area.
The Russian Prosecutor General Yuri Chaika held bilateral meetings with the leaders of the Prosecutor Offices of the People's Republic of China, Islamic Republic of Iran and Republic of Tajikistan, at which they discussed issues of international cooperation.
The next meeting of the Prosecutors General of the Shanghai Cooperation Organization will be held in Kazakhstan in 2015.
