The Consultative Council of the European Prosecutors (CCPE) held a meeting on 29-30 of November 2007, in Strasbourg, the headquarters of the Council of Europe that united 47 European countries.
The Russian delegation from the Prosecutor General’s Office of the Russian Federation headed by Deputy Prosecutor General of the Russian Federation Alexander Zvyagintsev took part in that meeting.
At the initiative of the Russian delegation, the Opinion on the Improvement of International Cooperation in Criminal Matters was adopted. This document contains a wide range of recommendations addressed to the Committee of Ministers of the Council of Europe and its member states. In particular, the Opinion recommends as a priority task to update the main Conventions of the Council of Europe relating to criminal proceedings, first of all, the European Convention on Extradition adopted more than 50 years ago.
The CCPE Work Program for 2008-2009 was also approved. At the suggestion of the Russian delegates, the topic the “Role of the Prosecution Service outside the Criminal Field” was included in the list of priorities for 2008. Other priority topics were the “Alternative to Prosecution and the Role of Public Prosecutors in Exercising of their Powers” and “Mutual Relations between Public Prosecutors and Judges”.
The information of the Polish representative as to the intention of the new Government of Poland to consider the separation of powers of the Minister of Justice and the Prosecutor General who should be independent and impartial in his professional activities was taken into consideration.
Great interest was aroused by the reports of the French and Italian colleagues about the ongoing reforms in their countries within which, in particular, a question about centralization of the Prosecution Service with possible establishment of the post of the Prosecutor General was supposed to be discussed.
The Russian delegates met with several officials of the Council of Europe including Deputy Secretary General of the Council of Europe Maud de Boer-Buquicchio and discussed cooperation between the Prosecutor General’s Office of the Russian Federation and the Council of Europe in 2008, participation of the Prosecution Service of Russia in implementation of general measures, and implementation by several European countries of international treaties concerning the execution of requests for investigation and extradition. Supervision over compliance with electoral law was covered.
General questions of bilateral cooperation and provision of legal assistance in specific criminal matters were discussed during working meetings with the representatives of the European countries (Spain, Switzerland, Portugal, Slovakia, Bulgaria, Poland, and Ukraine).
