Today, on 3 October 2019, the 18th Meeting of Prosecutors Generals of the Member States of the Council of the Baltic Sea States was held in Tallinn. The Russian delegation was headed by Deputy Prosecutor General of the Russian Federation Alexei Zakharov.
Arthur Zavalunov, Head of the Legal Department of the Prosecutor General’s Office of Russia took part in the event as a member of the delegation. In his report, he focused on the problems and experience gained in countering crimes committed with the use of information and communication technologies, as well as the prospects for this work.
In addition, the representative of the Russian supervisory agency noted the lack of a single approach in obtaining cross-border access to electronic evidence, since each state has its own domestic practice.
The work to counter emerging challenges and threats in the information sphere will not be effective enough without proper interaction of law enforcement agencies at the interstate level, said Arthur Zavalunov.
He emphasized that any organizational and practical measures carried out within one country, taking into account the international nature of cybercrimes, can be most effective only if there is an appropriate mechanism of international legal cooperation.
None of the regional solutions may eliminate the challenges faced by the world community in this area. Attempts to apply any of the sectoral documents to all countries of the world are doomed to failure in advance, continued the head of the legal department of the Russian supervisory agency.
At the same time, the provisions of the Budapest Convention in paragraph 32 (b) of Article 32 contain provisions that directly jeopardize state sovereignty and security of the States participants. The head of the legal department of the Prosecutor General’s Office of Russia warned that such provisions pose a threat of violating the rights to privacy and protection of personal data.
Each state in the world should be able to take part in the development of an international universal document aimed at combating cybercrime, and make comments in the course of its elaboration, jointly determining the acceptable rules for international cooperation, the representative of the prosecutor’s office declared.
In the face of new challenges posed by the criminal community that uses the absence of borders in the virtual space without any doubt, we should be one step ahead in terms of international interaction and make all possible efforts to improve it, said Arthur Zavalunov at the end.
Deputy Prosecutor General of Russia Alexei Zakharov expressed hope that by joint efforts we will be able to take a new step towards strengthening mutual understanding between our states in a very complex and extremely important area of ensuring information security and combating crimes committed with the use of modem technologies. He emphasized that the implementation of our proposals will increase the efficiency of countering the challenges of cybercrime and will make the world a safer place.
