The Committee of Ministers of the Council of Europe adopted a recommendation to member-states on the role of prosecutors outside the criminal legal system

On the 19th of September 2012 in Strasbourg, the Committee of Ministers of the Council of Europe (CMCE) adopted a recommendation to member-states on the role of prosecutors outside the criminal legal system.

 

The representatives of the General Prosecutor's office of the Russian Federation actively participated in the elaboration of the recommendation, and due to their the initiative the consultative Council of European prosecutors in October 2008 applied to the CMCE with a proposal to consider the issues on elaboration of common European principles about the status, powers and working practices of public prosecutors outside the criminal legal field.

 

On the instructions of the Committee of Ministers, elaboration of the draft recommendation was carried out by a specially created group of experts which included a representative of the General Prosecutor's office of the Russian Federation as well.

 

In the recommendation and in its explanatory memorandum it is summarised the European practice and it contains the main principles of activities of prosecutors outside the criminal legal field.

 

According to a special research conducted in the framework of the Council of Europe, more than 40 Prosecutor's offices out of 47 member-states of the Council of Europe are endowed with the functions of outside the criminal legal field in more or less degree. The Prosecutor's offices of many countries, including the Russian Federation, have large powers outside the criminal legal field which are aimed towards the protection of public interests as well as the rights of individuals, in particular those from socially vulnerable groups of population (children, disabled persons, pensioners, etc.). This activity is carried out particularly in the framework of the law of social security, family, labour, civil, environmental, electoral and entrepreneurial rights.

 

This activity of Russian prosecutors allows protecting the rights and legitimate interests of millions of citizens every year.

 

The adopted recommendation together with the recommendation of the Committee of Ministers on the role of public prosecution in the sphere of criminal justice make up a complex of European standards relating to the prosecution activity.
