Today in the General Prosecutor's office of Russia it was held a meeting of the Prosecutor General of the Russian Federation Yury Chayka with the Minister of justice of the Republic of Italy Paola Severino.
The delegation is on an official visit to Moscow at the invitation of the Ministry of justice of the Russian Federation.
In the course of the meeting it was signed the Agreement on cooperation between the General Prosecutor's office of the Russian Federation and the Ministry of justice of the Republic of Italy.
The document provides for holding of meetings and consultations for the exchange of experience, cooperation in the field of mutual legal assistance in criminal matters and extradition, professional trainings and improvement of qualification of employees of the departments. Moreover, the Agreement provides for the exchange of information about the legal system and legislation of the two countries, carrying out of joint researches, conferences and seminars on topical issues of the activity.
The Prosecutor General of the Russian Federation noted that this document will also allow examining the legislation and law enforcement practice of Italy on attraction to the responsibility of legal persons involved in committing of crimes as well as depriving criminals of incomes obtained from their illegal activities, including through their confiscation without announcement of their sentences.
The sides also expressed their confidence that the Agreement will become a real tool which allows pacing into a new level of interaction and contribute to enhancing the efficiency of activities in the field of protection of the rights and freedoms of a human being and a citizen.
Welcoming the guests, Yury Chayka noted that Russia and Italy have been tied up with friendly relations based on mutual interest in strengthening of democracy, international peace and security. It is developing a political dialogue and is established a high rhythm of meetings at the level of heads of our States and governments, heads of various ministries and departments. An integral part of a dynamic process of the development of Russian-Italian relations are the contacts between the authorities of the Prosecutor's office and the Ministry of justice in which qualitative changes are occurring as well.
The Prosecutor General of the Russian Federation emphasized that for a number of years the most topical issues of bilateral cooperation including in the field of extradition and legal assistance in criminal matters are discussed on a regular basis in the format of working meetings and consultations of Russian prosecutors with representatives of the Ministry of justice of the Republic of Italy as well as with the Prosecutor General of the Supreme court of Cassation of Italy. So, Yury Chayka stated that achieved agreements positively influence on the provision of the principle of inevitability of responsibility for committed crimes.
It was noted that interdepartmental cooperation is implemented not only in a bilateral format but also in the framework of the Council of Europe in the matters of modernisation of European conventions on extradition and legal assistance in criminal matters, including in the part of developing of a mechanism for resolution of disputes arising during the consideration of extradition requests.
The parties discussed the key role of the Prosecutor's activities outside the criminal law field as an element of the protection of interests of the state as a whole through an individually taken citizen. In this regard Yury Chayka noted that the next step towards strengthening and development of the human rights of powers of the bodies of the Prosecutor's office at the international level will be adoption by the Committee of Ministers of the Council of Europe of a recommendation about the role of public prosecution outside the criminal law field which is elaborated upon the initiative and with participation of the General Prosecutor's office of the Russian Federation. The Project of the document was approved at the end of June of this year at the plenary session of the European Committee on legal cooperation and submitted for consideration to the Committee of Ministers of the Council of Europe.
Moreover, the sides discussed the topic of cooperation in the struggling against organized criminality and «laundering of incomes» obtained by criminal way. This work is carried out in accordance with the Memorandum about cooperation between the General Prosecutor's office of the Russian Federation and the National Board for the fight with the mafia from 2002. Stable interest in the exchange of experience in this area served as the basis for decision-making in developing of the meetings of Russian and Italian experts into the meetings of more regular basis. For this it was developed the project of the Program of cooperation between the General Prosecutor's office of the Russian Federation and the National Prosecutor's office of the Italian Republic on the fight with the mafia for the years of 2013-2014, the signing of which is planned for October of this year.
The Minister of justice of the Republic of Italy thanked Yury Chayka for the reception and the opportunity to exchange opinions on the most topical issues of cooperation. She particularly noted the positive influence of his personal involvement in the processes of modernization and improvement of the mechanisms of interdepartmental cooperation and also, supported the work of the Russian Prosecutor's office in preparation of new legal mechanisms.
