Spain extradited to Russia former director of Uprdor “Volga” convicted of fraud and national of Ecuador accused of cocaine smuggling and sale

Upon request of the Prosecutor General’s Office of the Russian Federation competent authorities of Spain extradite to Russia Sergey Gavrilov, Russian national, and Francisco Xavier Cortez Qunonez, Ecuadorian national.

Mr. Gavrilov is accused of a crime, envisaged by Article 286 part 1 (exceeding official powers) of the Criminal Code of the Russian Federation. Also, on 16.09.2015, the Leninsky District Court of the city of Cheboksary of the Chuvash Republic found him guilty of crimes, envisaged by Article 33 part 5, Article 159 part 4 (mediation in fraud) and Article 285 part 1 (abuse of official powers) of the Criminal Code of the Russian Federation. He was sentenced to four years of deprivation of liberty.

According to the court ruling, in May 2012, head of the FKU “Department for Automotive Highway Nizhny Novgorod-Ufa of the Federal Road Agency” Mr. Gavrilov assisted in provision of information and elimination of obstacles for stealing of monetary funds of the “Chuvashavotor”, OJSC, in amount of 11 million and 500 thousand rubles, whose absolute owner is the Chuvash Republic.

Money were transferred to Mr. Gavrilov and another person as a reward for alleged acts committed by them and aimed at falsification of results of auction for a state contract.

In the period from April to September 2013 Mr. Gavrilov concluded state contracts with “Voddorsroy”, LLC and “Road Construction Transportable Mechanized Column “Syzranskaya”, CJSC, for maintenance of motorroads of the FKU Uprdor “Volga” in the sum of 106 million and 664 thousand rubles. At the same time these road parts were under warranty maintenance of “Doriss”, OJSC and “Mordovdor-Stroy”, LLC. As a result, material damage in the indicated sum was inflicted upon the budget of the Russian Federation.

Moreover, a court is examining a criminal case against Mr. Gavrilov, according to which, he, holding the above-stated post, concluded with the GUP of the Chuvash Republic “the Republican Department of Capital Construction” contract for the performance of works. Under this contract, in the period from September 2012 to March 2013, subcontracted organization SPF “DORStoy Remont”, LLC, conducted construction, assembly and land works on the land plots owned by “the SP Streletskoe”, LLC, and thus inflicted damage to the sum of 3 million and 823 thousand rubles.

In January 2016, upon instruction of the Prosecutor General’s Office of the Russian Federation, Mr. Gavrilov was declared internationally wanted. In May 2019 he was detained on the territory of Spain, and the Prosecutor General’s Office of the Russian Federation sent a request for his extradition.

In October 2020 the Council of Ministers of the Kingdom of Spain took a positive decision on his extradition to Russia.

Also, upon request of the Prosecutor General’s Office of the Russian Federation, foreign colleagues extradited Francisco Xavier Cortez Qunonez for making him criminally liable.

He is accused of perpetration of crimes, envisaged y Article 229.1 part 4 paragraphs “a, b” (smuggling of narcotic drugs, by an organized group, on especially large scale) and Article 228.1 part 5 (illegal turnover of narcotic drugs, by an organized group, on especially large scale) of the Criminal Code of the Russian Federation.

According to the investigation, in the period from October to November 2018, national of Ecuador Francisco Xavier Cortez Qunonez, together with other persons, on a motor vessel “Baltic Autumn”, bounding from port Guayaquil, the Republic of Ecuador, to port Saint-Petersburg, moved seven kilograms of cocaine though the custom border within the Eurasian Economic Community. Later, the narcotic drug was sold on the territory of Saint Petersburg.

After perpetration of the crime, he escaped from the law enforcement bodies and was put in a search list.

In June 2020 the accused was detained in Spain. The Prosecutor General’s Office of the Russian Federation sent foreign colleagues a request for his extradition, which was satisfied in February 2021.

Owing to the close cooperation between the Prosecutor General’s Office of the Russian Federation and the competent authorities of the Kingdom of Spain, positive decision on his extradition to Russia was taken.

Officers of the Federal Penitentiary Service of Russia and Russian Bureau of Interpol will escort Sergey Gavrilov and Francisco Xavier Cortez Qunonez to Moscow.
