The Prosecutor General’s Office of the Russian Federation has granted the request of the Ministry of Justice and Public Security of the Federative Republic of Brazil for extradition of Mr. Eduardo Fauzi Richard Cerquise with the purpose of his criminal prosecution for attempted murder.
During the extradition examination it was established that a criminal case is pending in the 3rd Criminal Court of the Region of Rio de Janeiro of the Federative Republic of Brazil against Mr. Eduardo Fauzi Richard Cerquise accused under Article 4, item II; Article 121, paragraph 2, items II and III of the Criminal Code of the Federative Republic of Brazil.
He is accused of the fact that on 24.12.2019, in Rio de Janeiro, by preliminary agreement with other persons, having intention to kill a watchman, he threw Molotov cocktails at a video recording studio. However he could not finish his criminal intent due to the circumstances beyond his control.
On 30.12.2019, a duty judge of the Rio de Janeiro Federal Court, as well as the 3rd Criminal Court of the Region of Rio de Janeiro on 19.09.2020, issued an arrest warrant against Mr. Eduardo Fauzi Richard Cerquise; he was declared wanted.
The actions of the accused are punishable according to the Russian criminal legislation and fall under Article 30 part 3; Article 105, part 2 “f, g” (attempted murder, committed by dangerous means, by a group of persons by preliminary agreement) of the Criminal Code of the Russian Federation. The penalty provided for by the above articles is imprisonment for the term of more than one year. The limitation period of criminal prosecution of the fugitive has not elapsed yet under the legislation of both the Russian Federation and the Federative Republic of Brazil.
Decision of the Prosecutor General’s Office of the Russian Federation to grant extradition of Mr. Eduardo Fauzi Richard Cerquise has become final. The Russian Federal Penitentiary Service has been charged with the surrender of the fugitive.
Mr. Eduardo Fauzi Richard Cerquise will be convoyed to Rio de Janeiro.
